1. About these terms
Cod Ladders ("we", "us") is an independent platform based in New South Wales, Australia. These Terms of Service ("Terms") are a legal agreement between you and us covering your use of codladders.com and the Cod Ladders service (the "Service").
By creating an account or using the Service you agree to these Terms, the Platform Rules and the Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
- You must be at least 13 years old to create an account.
- You must have the legal capacity to enter this agreement. If you are under 18, you confirm a parent or guardian has agreed to these Terms on your behalf.
- The Service is currently offered to the Australia and New Zealand region. Other regions may be added later.
- You must own a legitimate copy of the supported game and hold a valid PlayStation Network account.
3. Your account
- Provide accurate information and keep it up to date.
- You are responsible for your account, your password, and everything that happens under your account.
- One account per person. Do not share, sell, buy or transfer accounts.
- Do not create an account to evade a ban, restriction or suspension.
- Tell us promptly if you believe your account has been compromised.
4. The Service
- Cod Ladders provides competitive ladders and match organisation for console gaming. We provide the platform. We do not host, control or operate the game itself.
- Cod Ladders is free to play. Ladders, teams, matches and rankings cost nothing. There is an optional paid subscription, Cod Ladders Premium, which unlocks platform features and nothing else.
- There are no entry fees to play, there are no cash prizes, and ladder points are a ranking score with no monetary value.
- Premium is a subscription for platform features. It is not an entry fee, it does not buy any competitive advantage, and it has no bearing on match results or dispute decisions.
- Ladder points, rankings and any in platform score have no monetary value, cannot be exchanged for money or goods, and are not property. We may adjust, recalculate or reset them, including to correct errors or penalise rule breaking.
- We may add, change, suspend or remove features at any time. Cod Ladders Premium is the paid feature, and it is governed by the Premium terms below. Entry-fee or wagering products are not offered and are out of scope for these terms; if they are ever introduced they would need their own terms.
The Platform Rules form part of these Terms and cover fair play, match conduct, results, disputes, proof and penalties. Breaching them may result in match voids, strikes, restrictions, suspension or permanent termination of your account.
You specifically acknowledge that admin decisions on match results and disputes are final.
6. User content
- "User content" means anything you submit: usernames, team names, match chat, notes, evidence links, support messages and reports.
- You keep ownership of your user content. You grant us a non exclusive, worldwide, royalty free licence to host, store, reproduce and display it for the purpose of operating the Service.
- You are responsible for your user content and confirm you have the right to submit it.
- We may remove user content or refuse a name that breaches these Terms or the Platform Rules.
- Match chat and submitted evidence may be reviewed by admins to resolve disputes and enforce the rules.
7. Acceptable use
You must not:
- cheat, exploit, manipulate results, or interfere with fair competition;
- harass, threaten, defame or abuse other users or staff;
- scrape, harvest or bulk collect data from the Service, including other users' contact handles;
- use bots, automated scripts or unauthorised means to access the Service;
- attempt to breach, probe or circumvent security, access controls or rate limits;
- reverse engineer or attempt to derive source code, except where that restriction is prohibited by law;
- upload malicious code or disrupt the availability of the Service;
- use the Service for anything unlawful.
8. Suspension and termination
- We may suspend or terminate your access, remove content, void matches, or apply strikes, restrictions and bans where we reasonably believe you have breached these Terms or the Platform Rules, or to protect the integrity of the competition or other users.
- You may stop using the Service at any time and can request account deletion (see the Privacy Policy).
- Sections that by their nature should survive termination (including clauses 6, 9, 10, 11 and 14) continue to apply.
9. Third party services and no affiliation
- Cod Ladders is an independent platform. We are not affiliated with, endorsed by, sponsored by or associated with Activision Publishing, Inc., Activision Blizzard, Treyarch, Sony Interactive Entertainment, or PlayStation.
- All game titles, trade names, trade dress, trademarks and related imagery are the property of their respective owners and are used for identification and descriptive purposes only.
- Your use of the game and of PlayStation Network is governed by those third parties' own terms. You are responsible for complying with them. Nothing here grants you rights in their products.
- The Service relies on third party providers (for example hosting, database and analytics providers). We are not responsible for their outages or acts.
10. Availability, beta status and data
- The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error free operation.
- The Service is in beta. Features may change or break, and data (including ladders, points and match history) may be reset, corrected or lost. Do not rely on the Service for anything critical.
- We may perform maintenance, migrations or resets during the beta.
11. Disclaimers and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
To the maximum extent permitted by law, and subject to the paragraph above:
- we exclude all implied warranties and conditions;
- we do not warrant that the Service will meet your requirements or be free of errors;
- where our liability cannot be excluded but can be limited, our liability is limited to resupplying the Service or paying the cost of resupply.
12. Limitation of liability
To the maximum extent permitted by law, and subject to clause 11:
- we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, opportunity, data or goodwill;
- our total aggregate liability arising out of or in connection with the Service is limited to the greater of AUD $100 or the total amount you paid us in the 3 months before the claim.
13. Cod Ladders Premium
This section applies if you subscribe to Cod Ladders Premium. It is in addition to the rest of these Terms.
What it is
- Premium is a subscription for platform features. It is not an entry fee, it does not buy any competitive advantage, and it has no bearing on match results or dispute decisions. Paying does not make you more likely to win a dispute.
- Premium is billed in advance for the interval you choose. It renews automatically at the end of each interval until you cancel.
- Prices are shown in Australian dollars on the subscribe page before you confirm.
What Premium includes
- No daily match limit. Free accounts can play a set number of matches per day, shown on the subscribe page. Premium removes that limit.
- A Premium badge beside your name.
- Priority support. Your support tickets are placed ahead of others in the queue, and we aim to reply within 24 hours. This is a target, not a guarantee, and it is not a service level agreement. We do not promise a response time.
- Early access to some new features, modes and ladders.
- Priority support means your ticket is read sooner. It does not mean a better outcome. Premium has no effect on dispute decisions, match results, points, seeding or matchmaking. A paying member and a free player who bring the same dispute get the same ruling.
Age and payment authority
- By subscribing you confirm that you are 18 or older, or that you have your parent or guardian's permission and they have authorised the payment. The person who owns the payment method is responsible for the charge.
Cancelling
- You can cancel at any time. Cancelling stops the next renewal.
- When you cancel, your Premium access continues until the end of the period you have already paid for, and then reverts to the free tier.
- Where lawfully permitted, we do not refund part periods. Cancelling part way through an interval does not produce a pro rata refund.
Suspension, termination and refunds
- If your account is suspended, restricted or terminated for breaching these Terms or the Platform Rules, you are not entitled to a refund of any part of the current period, and your Premium access ends with your access to the Service.
- Nothing here limits your rights under the Australian Consumer Law. See "Disclaimers and Australian Consumer Law" above: nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, and where a failure is not of a major kind our liability is limited, at our option, to resupplying the service or paying the cost of resupply.
Chargebacks
- If you dispute a charge with your bank or card issuer instead of contacting us, we may suspend your account while the dispute is resolved.
- We keep records sufficient to respond to a payment dispute, including your signup, your acceptance of these Terms, your subscription history and your use of the Service. See the Privacy Policy for how long we keep information.
- Contact support first. Most billing problems are faster to fix directly than through a chargeback.
Changes and discontinuation
- We may change the price or what Premium includes. We will tell you before a change takes effect, and a price change applies from your next renewal, not the period you have already paid for.
- We may stop offering Premium. If we do, your current paid period is honoured to its end, or we refund the unused part of it, and your account reverts to the free tier. The free tier remains free to play.
14. Indemnity
You indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or the Platform Rules, your user content, or your unlawful use of the Service, except to the extent caused by our own breach or negligence.
15. Privacy
We handle personal information in accordance with the Privacy Policy and the Privacy Act 1988 (Cth).
16. Changes to these Terms
We may update these Terms. If a change is material we will give reasonable notice in the app. Continuing to use the Service after the change takes effect means you accept the updated Terms. If you do not accept, stop using the Service and request deletion of your account.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non exclusive jurisdiction of the courts of New South Wales.
